CUTEK PRIVACY POLICY

Thank you for using CUTEK. We are committed to protecting your privacy and, for that reason, we have adopted this Privacy Policy to explain our data collection, use, and disclosure practices for the CUTEK services (including the CUTEK website, web-based applications, and any other tools, products, or services provided by CUTEK that link to or reference this Privacy Policy) (collectively, the “Services”). The Services are owned and operated by CUTEK, LLC, a Texas limited liability company (“we”, “us” or “our”).

This Privacy Policy applies to information CUTEK collects through the Services, as well as other information provided to us online or offline by third parties when we associate that information with customers or users of the Services. It does not apply to information collected from our employees, contractors, or vendors. It also does not apply to information that you ask us to share with third parties or that is collected by certain other third parties whose software or services are featured or included in the Services. Finally, except as specified in Section 3 below, to the extent that you are an account holder or debtor of a financial institution that is a CUTEK client (each, a “CUTEK Client”), this Privacy Policy does not apply to any of your data that CUTEK processes in the course of providing its services to any CUTEK Clients. If you are an account holder or debtor of a CUTEK Client, CUTEK’s treatment of your information is governed by our agreement with such CUTEK Client, and you should consult such CUTEK Client’s privacy policy for more information regarding how your information is used and your privacy choices with respect to such information.

This Privacy Policy describes, among other things: personal and other information we collect about you; how we use your information; how we may share your information with third parties; and your choices regarding the personal information we collect about you. 

1. Consent

By accessing or using the Services, you consent to this Privacy Policy. If you do not agree with this Privacy Policy, please do not access or use the Services. Information gathered through the Services may be transferred, used, and stored in the United States or in other countries where our service providers or we are located. If you use the Services, you agree to the transfer, use, and storage of your Personal Information in those countries. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. You agree that all transactions relating to the Services or CUTEK are deemed to occur in the United States, where our servers are located.

2. Collection of Your Personal and Other Information

When you register for or use our Services, we collect Personal Information. “Personal Information” means information that can identify or reasonably be linked to an individual, such as:

We also collect non-Personal Information relating to the Services, meaning information that does not personally identify an individual. City and state location (not precise location)

We will not use non-Personal Information to identify you. If we combine it with Personal Information, we treat it as Personal Information.
Information may be collected directly by CUTEK or by third parties that support the Services.

Improve our operations and Services
Process transactions
Provide customer service
Communicate with you regarding accounts, transactions, newsletters, or Service updates
Send or display personalized content or offers

No mobile information will be shared with third party/affiliates for marketing or promotional purposes.
We may also de-identify and aggregate data, including data related to CUTEK Clients’ end users, and use such aggregated data for business purposes, including improving and developing artificial intelligence systems, features, and functionality.

4. Disclosure of Your Information

We may disclose Personal Information in the following circumstances:

We may share Personal Information when necessary to provide the Services or when you authorize us to do so.

We may share information with Service Providers, including companies that assist with payment processing, data storage, hosting, marketing, analytics, audits, and customer support. These providers are permitted to use Personal Information only as needed to perform services on our behalf or as required by law.

We may share information with Online Tool Providers, which are third-party software tools integrated into the Services (including APIs or SDKs) that may process Personal Information or non-Personal Information. These providers may use information according to their own privacy policies.

We may disclose information if we believe in good faith that it is necessary to:

Enforce our Terms or investigate violations
Comply with legal or regulatory obligations
Respond to lawful government requests
Protect the rights, property, or safety of CUTEK, users, or others

If CUTEK is involved in a merger, acquisition, sale of assets, bankruptcy, or similar event, information may be transferred as part of that transaction. We will attempt to notify users if required.

We may also share aggregated or de-identified information with business partners, investors, advertisers, or other third parties for legitimate business purposes.

5. Cookies and Automatic Information Collection

We automatically collect Personal and non-Personal Information when you use the Services, including how you interact with pages, features, and tools.

We may use cookies, local storage, pixels, tags, and similar technologies to collect and store data.

Third-party tools may also collect information automatically, including:

Zoom

We are not responsible for information you have already shared with others.

CUTEK provides transparency regarding Personal Information practices as described in this Policy. Additional rights may apply depending on your state of residence.

9. Nevada Residents

We do not sell Personal Information. You may contact info@cutek.com with questions.

10. Children

The Services are not intended for individuals under 18. We do not knowingly collect Personal Information from anyone under 18.

11. Information Security

We use reasonable safeguards to protect Personal Information, including encryption (SSL/TLS), firewalls, and access controls. However, no system can guarantee complete security.

Access to Personal Information is limited to employees, contractors, and service providers who need it to operate the Services.

12. Third-Party Websites

The Services may link to third-party websites or services. We are not responsible for their privacy practices. You should review their policies before providing any information.

13. Changes to This Policy

We may update this Privacy Policy from time to time. Updates will be posted with a revised “Last Updated” date. Continued use of the Services after changes means you accept the updated Policy.
